1. Purpose of This Policy
This Acceptable Use Policy (“AUP”) governs the use of all services, systems, software, artificial intelligence tools, automation frameworks, CRM implementations, funnels, communications systems, and consulting services (collectively, the “Services”) provided by LBBH AI Solutions (“Company,” “we,” “our,” or “us”).
This AUP is incorporated by reference into our Terms of Service. Any violation of this policy constitutes a material breach of agreement.
2. Scope of Application
This Policy applies to:
• Clients
• End users
• Contractors acting on behalf of Clients
• Anyone accessing Company systems
• Anyone using Company-configured CRM or AI systems
You are responsible for ensuring that your employees, agents, affiliates, and contractors comply with this Policy.
3. Lawful Use Requirement
All Services must be used in compliance with:
• Applicable local, state, federal, and international laws
• Data protection laws
• Consumer protection laws
• Anti-spam regulations
• Intellectual property laws
• Industry-specific regulatory requirements
You are solely responsible for ensuring compliance within your industry.
4. Prohibited Conduct
You may NOT use our Services for any unlawful, deceptive, abusive, or unethical purpose.
Prohibited activities include, but are not limited to:
A. Fraud & Deceptive Practices
• Identity theft
• Phishing
• Impersonation of individuals or businesses
• Financial scams
• False advertising
• Misrepresentation of credentials
B. Unlawful Marketing & Messaging
• Sending unsolicited bulk SMS or email campaigns
• Violating TCPA, CAN-SPAM, or similar regulations
• Harvesting contact lists without consent
• Circumventing opt-out mechanisms
• Manipulating communication systems to avoid carrier filters
You are responsible for obtaining proper consent before sending communications.
C. AI Misuse
You may not use AI systems configured by Company to:
• Generate illegal content
• Create harmful misinformation
• Impersonate individuals
• Produce defamatory statements
• Generate unlawful advice
• Automate harassment campaigns
AI systems must be used responsibly and with human oversight.
D. Intellectual Property Violations
• Uploading copyrighted material without authorization
• Infringing trademarks
• Distributing proprietary materials
• Reverse-engineering Company frameworks
You retain responsibility for all content uploaded into systems.
E. Data Abuse
• Uploading unlawfully obtained personal data
• Processing sensitive personal information without legal authority
• Violating privacy regulations
• Attempting to access unauthorized data
Company does not verify the legality of Client-provided data.
You assume full responsibility.
F. System Interference
• Attempting to hack, disrupt, or overload systems
• Introducing malware or harmful code
• Exploiting vulnerabilities
• Circumventing security measures
G. Harassment & Harmful Conduct
• Threatening behavior
• Hate speech
• Discrimination
• Cyberbullying
• Stalking
5. Industry-Specific Compliance
If you operate in regulated industries including but not limited to:
• Healthcare
• Financial services
• Legal services
• Education
• Government
You are solely responsible for ensuring compliance with industry regulations.
Company does not guarantee regulatory compliance unless explicitly stated in a signed agreement.
6. Monitoring & Enforcement
Company reserves the right to:
• Monitor system activity
• Investigate suspected violations
• Suspend access
• Terminate Services
• Remove content
• Report illegal activity to authorities
We are not obligated to monitor proactively but may do so at our discretion.
7. Immediate Suspension
We may immediately suspend or terminate Services without prior notice if:
• We suspect unlawful conduct
• We detect spam activity
• We detect regulatory violations
• Third-party platforms flag your account
• Your activity creates risk to Company infrastructure
No refunds will be issued for violations.
8. Indemnification
You agree to indemnify and hold harmless LBBH AI Solutions, its owners, officers, employees, contractors, affiliates, and agents from any claims, damages, losses, liabilities, or legal expenses arising from:
• Your misuse of Services
• Regulatory violations
• Improper data collection
• Unlawful messaging
• Content generated or distributed using our systems
This obligation survives termination.
9. Third-Party Platform Compliance
Services may rely on third-party platforms including CRM providers, hosting services, AI providers, and communication carriers.
You agree to comply with all third-party platform terms.
Company is not responsible for account suspensions or platform actions triggered by your conduct.
10. No Circumvention
You may not:
• Attempt to replicate Company systems
• Reverse engineer automation frameworks
• Bypass payment requirements
• Circumvent service limitations
11. Reporting Violations
If you become aware of misuse or security concerns, you agree to notify Company promptly.
12. Reservation of Rights
Company reserves the right to:
• Modify this Policy
• Enforce this Policy at its discretion
• Determine violations in its sole judgment
Failure to enforce a provision does not waive our right to enforce it later.
13. Survival
Sections relating to indemnification, liability limitations, and intellectual property survive termination.
14. Governing Law
This Policy shall be governed by the laws of the State of California.
