1. Purpose
This SMS & Communication Policy governs all text message (SMS), multimedia message (MMS), email, voice, and other electronic communications sent by or on behalf of LBBH AI Solutions (“Company,” “we,” “our,” or “us”).

Company is not responsible for:

10. Client Responsibility (If You Use Our Systems)
If you are a Client using CRM or automation systems configured by Company, you agree:
• To obtain express written consent from recipients before sending SMS
• To comply with TCPA, CAN-SPAM, and all applicable regulations
• Not to send unsolicited bulk messaging
• Not to use purchased or scraped contact lists
• Not to manipulate opt-out mechanisms
You assume full legal responsibility for compliance with messaging laws.
Company does not verify consent collection practices.
11. Recordkeeping
Company may retain opt-in and opt-out records for compliance purposes.
Clients are responsible for maintaining consent records if they operate messaging systems.
12. Prohibited Messaging Conduct
You may not use our systems for:
• Spam
• Harassment
• Threats
• Fraud
• Political misinformation
• Deceptive advertising
• Sending messages to individuals without consent
Violation may result in immediate suspension without refund.
13. Indemnification
You agree to indemnify and hold harmless LBBH AI Solutions, its owners, officers, employees, contractors, affiliates, and agents from any claims, penalties, fines, damages, or legal expenses arising from:
• Your failure to obtain proper consent
• Violations of TCPA
• Improper SMS campaigns
• Unauthorized marketing
• Carrier complaints
• Regulatory enforcement actions
This indemnification survives termination.
14. No Guarantee of Message Delivery
We do not guarantee:
• Message delivery
• Open rates
• Engagement rates
• Carrier approval
• Filtering avoidance
Messaging systems are subject to carrier and platform limitations.
15. Revocation of Consent
You may revoke consent at any time.
Revocation does not affect the legality of communications sent prior to revocation.
16. Geographic Limitations
Messaging regulations vary by jurisdiction.
